Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern access to and use of the Strivios website, creator dashboard, private creator decks and related online services available through https://strivios.com (collectively, the “Platform”).

Strivios is a gaming influencer marketing agency and creator network operated by:

In these Terms, “Strivios”, “we”, “us” and “our” refer to MB Double vision operating under the Strivios brand.

By creating an account, accessing a private creator deck, submitting information through the Platform, connecting a third-party account, or otherwise using the interactive features of the Platform, you agree to these Terms.

If you do not agree with these Terms, you must not use those features of the Platform.

2. Scope of These Terms

These Terms apply to users of the Platform, including:

visitors to the Strivios website;
creators using the Strivios creator dashboard or participating in the Strivios creator network;
brands, advertisers, agencies and other clients accessing creator information or private decks;
representatives, employees or contractors acting on behalf of such organisations; and
any other person using the Platform or its services.

These Terms govern use of the Platform itself.

Specific influencer campaigns, sponsorships, advertising services, creator engagements, payments, deliverables or other commercial collaborations may be governed by a separate agreement, insertion order, campaign confirmation, statement of work or other written arrangement between the relevant parties.

If there is a conflict between these Terms and a separately agreed written contract relating to a specific campaign or commercial service, the separate agreement will prevail in relation to that campaign or service.

3. About Strivios

Strivios is a specialist gaming influencer marketing agency and creator network.

Our services may include:

identifying and evaluating creators;
maintaining a curated creator network;
helping brands discover creators suitable for campaigns;
preparing creator recommendations and private creator decks;
collecting and presenting creator analytics and audience information;
facilitating introductions between brands and creators;
negotiating potential collaborations;
coordinating influencer marketing campaigns;
supporting campaign communication, planning and execution; and
providing creators with tools to manage relevant profile, pricing and analytics information.

The availability and functionality of particular services may change over time.

Strivios does not guarantee that joining the creator network will result in sponsorship opportunities, campaigns, revenue or any minimum level of work.

Similarly, Strivios does not guarantee that any creator presented to a brand will accept a proposed campaign or that a campaign will achieve a particular commercial result.

4. Commercial Campaigns and Agreements

The Platform facilitates creator discovery, campaign matching and campaign management, but accessing the Platform or appearing in the Strivios creator network does not by itself create a binding influencer campaign agreement.

A creator remains free to accept or decline individual campaign opportunities unless otherwise agreed in writing.

A brand remains free to accept, reject or negotiate creator proposals presented by Strivios.

Pricing, deliverables, campaign dates, usage rights, exclusivity, payment terms, cancellation provisions and other campaign-specific conditions will be agreed separately where applicable.

Where Strivios provides services directly to a brand or client, MB Double vision is the legal entity providing those services unless expressly stated otherwise in writing.

The Platform does not currently process campaign payments directly through the website. Payments relating to campaigns or services may instead be made through invoices, bank transfers, payment providers or other methods specified in the applicable commercial agreement.

5. Creator Network and Creator Accounts

5.1 Joining the Creator Network

Creators may be invited to or approved for inclusion in the Strivios creator network.

Unless a separate written agreement expressly states otherwise, participation in the Strivios creator network is non-exclusive.

Joining the network does not prevent a creator from:

working directly with other brands;
working with other agencies;
obtaining sponsorships independently; or
declining opportunities presented by Strivios.

Participation in the network does not create an employment relationship, partnership, joint venture or other similar relationship between the creator and MB Double vision.

Neither party is authorised to enter into agreements or incur obligations on behalf of the other unless expressly authorised in writing.

5.2 Creator Accounts

Creators may be provided with access to a Strivios account or dashboard.

Creators are responsible for:

providing accurate and reasonably current information;
maintaining the confidentiality of their login credentials;
ensuring that information they submit does not infringe third-party rights;
promptly informing Strivios of suspected unauthorised account access; and
ensuring that pricing, contact and profile information they provide is accurate.

Strivios may correct, remove or request clarification of information that appears inaccurate, outdated or misleading.

5.3 Removal from the Creator Network

Creators may request:

deletion of their Strivios account;
disconnection of linked third-party services;
removal of information they have submitted; or
removal from the Strivios creator network.

Certain information may be retained where necessary to comply with legal obligations, resolve disputes, establish or defend legal claims, maintain accounting records or meet other lawful requirements.

6. Third-Party Account Connections

The Platform may allow creators to connect third-party services, including services such as YouTube.

Connecting such a service is voluntary.

When you connect a third-party account, you authorise Strivios to access the information permitted through the relevant integration and in accordance with the permissions you approve.

Your use of third-party services remains subject to the terms, privacy policies and other rules of those third-party providers.

Strivios does not control third-party platforms and is not responsible for their availability, functionality, security or changes to their APIs or services.

You may disconnect supported third-party integrations where such functionality is available.

7. Private Creator Decks and Client Access

Strivios may provide brands, agencies and other prospective clients with access to private creator decks, shortlists or campaign recommendations.

These may contain information such as:

creator names and channel information;
social media links;
audience statistics;
engagement and performance metrics;
audience demographics;
creator categories or niches;
indicative or proposed pricing; and
other information relevant to evaluating a potential collaboration.

Private deck links may be protected by tokens or other access controls and may be restricted, changed, disabled or expire.

Unless Strivios expressly states otherwise, private deck content is provided solely for legitimate evaluation of potential Strivios-related campaigns or collaborations.

Recipients must not:

publish private deck links;
provide unrestricted public access to deck content;
scrape or systematically extract deck data;
sell or commercially redistribute deck information;
use automated systems to harvest creator information; or
attempt to bypass technical access controls.

A recipient may share relevant information internally with employees, representatives or professional advisers who reasonably need it for evaluating the proposed collaboration, provided that appropriate confidentiality is maintained.

Any additional confidentiality or non-circumvention obligations agreed separately between Strivios and a client remain unaffected by these Terms.

8. Creator Information and Publicly Available Data

The Platform may contain information relating to creators who have joined Strivios as well as information obtained from publicly available sources or authorised third-party integrations.

Public creator information may include channel names, social media profiles, follower or subscriber counts, publicly visible content statistics and similar information.

The inclusion of publicly available creator information on the Platform does not necessarily mean that the creator has entered into an exclusive representation agreement with Strivios.

Where a creator has not expressly joined the Strivios network, inclusion of publicly available information should not be interpreted as an endorsement, partnership or formal representation relationship.

Third-party names, logos, channels, trademarks, content and other intellectual property remain the property of their respective owners.

9. Analytics and Data Accuracy

Creator analytics, audience information, estimates, rankings, averages and other metrics displayed through Strivios may be obtained from:

creators themselves;
third-party APIs;
connected social media accounts;
publicly available information;
historical data; or
calculations and estimates generated by Strivios.

Such information may change over time and may contain delays, inaccuracies or incomplete information.

Strivios makes reasonable efforts to provide useful information but does not guarantee that analytics, estimates or creator information are complete, current or error-free.

Historical performance does not guarantee future performance.

Brands and other users remain responsible for their own commercial decisions and campaign evaluations.

10. Intellectual Property

10.1 Strivios Platform and Materials

Unless otherwise indicated, the Platform and its original:

software;
source code;
design;
layout;
graphics;
databases;
written materials;
creator deck structure;
branding; and
other proprietary materials

are owned by or licensed to MB Double vision.

The Strivios name, visual identity and related branding may not be used in a way that suggests endorsement, affiliation or authorisation without prior permission.

Except as expressly permitted by these Terms or applicable law, users may not reproduce, modify, distribute, sell, license, reverse-engineer or commercially exploit protected parts of the Platform without prior written permission.

10.2 Creator Content

Creators retain ownership of their own channels, videos, images, trademarks, media and other intellectual property.

Where a creator voluntarily provides profile information, images, social links, campaign materials or other content to Strivios, the creator grants MB Double vision a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that material only to the extent reasonably necessary to:

operate the Strivios Platform;
maintain the creator’s profile;
present the creator to prospective brands or clients;
prepare campaign recommendations or private decks;
facilitate collaborations; and
provide Strivios services.

This licence does not transfer ownership of creator content to Strivios.

The licence ends when the relevant information is no longer reasonably required for these purposes, subject to lawful retention requirements and previously created campaign or business records.

The creator confirms that they have the necessary rights to provide any material submitted to Strivios.

11. Privacy and Personal Data

MB Double vision processes personal data in connection with Strivios in accordance with applicable data protection law, including the General Data Protection Regulation (“GDPR”), where applicable.

Our Privacy Policy explains:

what personal data we collect;
why we process it;
the legal bases for processing;
how information may be shared;
retention periods;
international transfers where applicable; and
users’ data protection rights.

Use of the Platform is also subject to the Strivios Privacy Policy.

12. Cookies and Similar Technologies

Strivios may use cookies, local storage and similar technologies for purposes including:

authentication;
session management;
security;
saving preferences;
maintaining private deck access;
Platform functionality; and
other purposes described in our Cookie Policy.

Where consent is required by applicable law for non-essential cookies or similar technologies, such technologies will be used only in accordance with the applicable consent requirements.

13. Communications

Strivios may contact users regarding:

account administration;
Platform functionality;
creator opportunities;
campaign discussions;
requested services;
security matters;
operational updates;
changes affecting an existing relationship; and
legal or regulatory notices.

Operational and contractual communications may be necessary for providing the requested services.

Marketing communications will only be sent where permitted under applicable law. Where required, users will be given an appropriate method to withdraw consent or opt out of marketing communications.

14. Acceptable Use

You must use the Platform lawfully and responsibly.

You must not:

use the Platform for unlawful, fraudulent or abusive purposes;
attempt to gain unauthorised access to accounts, systems or private information;
bypass authentication, tokens or other access restrictions;
interfere with the security or proper operation of the Platform;
introduce malicious software, scripts or code;
scrape, harvest or systematically extract Platform data without permission;
resell or commercially redistribute private Strivios data without authorisation;
impersonate another person or organisation;
knowingly provide materially false or misleading information;
infringe intellectual property, privacy or other rights of third parties;
publicly distribute private creator deck links;
use automated means to access restricted sections of the Platform without authorisation; or
use the Platform in a manner that could reasonably damage Strivios, its users or its infrastructure.

Strivios may take reasonable technical or organisational measures to prevent prohibited activity.

15. Eligibility and Minors

The Strivios creator dashboard and private Platform services are intended for users aged 16 or older.

Users under the age of 16 must not create a Strivios account or connect third-party accounts to Strivios.

If you are between 16 and 18 years old, you may only enter into commercial agreements through Strivios where you have the legal capacity to do so or where the required consent or authorisation of a parent or legal guardian has been obtained.

Strivios may request reasonable evidence of age or required authorisation before facilitating a commercial collaboration.

Nothing in this section prevents younger users from viewing publicly accessible parts of the website that do not require an account or the provision of personal data.

16. Platform Availability and Changes

We aim to maintain reliable access to the Platform but do not guarantee uninterrupted or error-free operation.

The Platform may occasionally be unavailable because of:

maintenance;
security updates;
infrastructure problems;
third-party service failures;
software changes;
circumstances outside our reasonable control; or
other technical or operational reasons.

Strivios may modify, improve, replace or discontinue particular Platform features where reasonably necessary.

Where a material change significantly affects an ongoing paid service or contractual relationship, any applicable separate agreement and mandatory legal requirements will continue to apply.

17. Suspension and Termination

Strivios may restrict, suspend or terminate access to some or all Platform functionality where reasonably necessary because of:

a material breach of these Terms;
suspected fraud or unlawful activity;
security risks;
misuse of private data;
attempts to circumvent access controls;
infringement of third-party rights;
legal or regulatory requirements; or
conduct that materially threatens Strivios, its users or the Platform.

Where reasonably practicable and legally required, Strivios will provide appropriate notice or information regarding the action taken.

Creators may request account deletion or removal from the creator network at any time.

Termination of Platform access does not automatically terminate rights or obligations already arising under separate campaign agreements, invoices or other commercial contracts.

Sections that by their nature should continue after termination—including provisions concerning intellectual property, confidentiality, liability and governing law—will continue to apply.

18. Third-Party Websites and Services

The Platform may contain links to third-party websites, social networks, creator channels, payment providers or other external services.

Strivios does not control those third parties and is not responsible for their:

content;
availability;
security;
privacy practices;
products;
services; or
terms and conditions.

A link or reference to a third party does not constitute an endorsement unless Strivios expressly states otherwise.

Users should review the applicable terms and privacy policies of third-party services before using them.

19. No Guarantee of Campaign Results

Influencer marketing involves factors outside Strivios’ control.

Unless expressly guaranteed in a separate written agreement, Strivios does not guarantee:

a particular number of views, impressions, clicks or conversions;
sales or revenue;
audience growth;
campaign profitability;
creator availability;
creator acceptance of a campaign;
continued social media platform availability;
algorithmic performance; or
any particular commercial outcome.

Any campaign-specific performance guarantees expressly agreed in writing remain subject to the relevant separate agreement.

20. Disclaimer

The Platform and general information available through it are provided on an “as available” basis.

To the fullest extent permitted by applicable law, Strivios does not warrant that:

the Platform will always be available;
every feature will operate without interruption or error;
all third-party information will be accurate or current;
the Platform will meet every user’s particular business requirements; or
use of the Platform will result in a successful commercial collaboration.

Nothing in these Terms excludes warranties, rights or remedies that cannot lawfully be excluded.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, these Terms do not exclude or restrict liability for fraud, intentional misconduct, or other liability that cannot legally be excluded or restricted.

To the fullest extent permitted by applicable law, MB Double vision will not be liable for indirect, incidental, special or consequential losses arising solely from use of the Platform, including loss of profits, revenue, business opportunities or data, except where such liability cannot lawfully be excluded.

For users acting in the course of a business or profession, MB Double vision’s aggregate liability arising solely from access to or use of the Platform under these Terms will not exceed the greater of:

(a) €100; or
(b) the amount actually paid by that user specifically for access to the Platform during the 12 months preceding the event giving rise to the claim.

This Platform liability limitation does not determine liability arising from a separately agreed influencer campaign, marketing service, creator agreement or other commercial contract. Liability relating to those services will be governed by the applicable separate agreement and mandatory law.

Nothing in these Terms limits rights or remedies available under applicable data protection law or other mandatory legislation.

22. Responsibility for Your Use of the Platform

Users are responsible for their own conduct when using the Platform and for information they submit.

A business user who unlawfully uses the Platform or knowingly infringes third-party rights may be responsible for losses reasonably resulting from that conduct in accordance with applicable law.

Nothing in this section creates liability beyond what is permitted under applicable law.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Lithuania, without prejudice to mandatory provisions of applicable law.

If you use Strivios in connection with your trade, business or professional activity, disputes relating to these Terms that cannot be resolved amicably will be subject to the competent courts of the Republic of Lithuania, unless the parties agree otherwise in writing.

If you qualify as a consumer under applicable law, nothing in these Terms deprives you of mandatory consumer protections or jurisdiction rights available to you under Lithuanian or European Union law.

Before commencing formal proceedings, users are encouraged to contact Strivios so that the parties can attempt to resolve the matter directly.

24. Changes to These Terms

We may update these Terms where reasonably necessary, including because of:

changes to the Platform or our services;
changes to our business model;
security requirements;
changes in applicable law or regulation; or
improvements or clarifications to these Terms.

The current version will be published on this page together with its “Last updated” date.

Where a material change affects registered users or an ongoing Platform relationship, we may provide additional notice where appropriate or required by law.

Changes apply prospectively from their effective date and do not retrospectively alter rights or obligations already established under a separate agreement unless the parties agree otherwise or applicable law provides otherwise.

25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

The affected provision will be interpreted or limited only to the extent necessary to make it valid and enforceable where legally possible.

26. No Waiver

If Strivios does not immediately enforce a provision of these Terms, this does not mean that Strivios has waived the right to enforce that provision later.

Any waiver must be made expressly and does not constitute a continuing waiver unless expressly stated.

27. Entire Agreement Regarding Platform Use

These Terms, together with the Privacy Policy, Cookie Policy and any other policies expressly incorporated into them, constitute the general terms governing use of the Platform.

They do not replace separate written agreements concerning individual campaigns, advertising services, creator engagements, payments or other commercial relationships.
